Washington, D.C., November 10, 2025 — Administrator of the Environmental Protection Agency, Mr. Lee M. Zeldin, today officially put his signature on a rule that was proposed with a view to changing the Toxic Substances Control Act (TSCA) regulations governing the reporting and keeping records of per- and polyfluoroalkyl substances (PFAS). The event is expected to be a source of significant regulatory relief for the industries impacted.
Key Amendments
EPA is proposing to incorporate several critical exemptions to the PFAS data reporting regulation finalized in October 2023:
- De Minimis Exemption: PFAS concentrations below 0.1% in mixtures or articles would be exempt from reporting
- Imported Articles Exemption: PFAS imported as part of an article would not require reporting
- Byproducts, Impurities, and Non-Isolated Intermediates: Manufacturing activities meeting specified conditions would be exempt
- Research & Development (R&D) Exemption: Small quantities of PFAS manufactured solely for R&D purposes would be exempt
Economic Impact
The worst-case scenario according to EPA regarding the proposed rule is that it will result in the industry bearing a lesser burden of 10-11 million total hours which in turn will save them $786-$843 million when put in comparison with the 2023 final requirements. For small businesses, the corresponding figures are 9.3-9.9 million hours saved and $703-$761 million reduced compliance costs.
Policy Background
This move comes in the wake of the issuance of Executive Orders by President Trump requiring that federal agencies re-evaluate regulations to ensure they are in line with the law and government policy. The EPA decided that certain reporting requirements were placing an unfair burden on small manufactures and that some information was unnecessary for statutory compliance under TSCA Section 8(a)(7).
Public Comment Period
The EPA will be receiving public comments for a period of 45 days starting from the date of the notice in the Federal Register. Please submit your comments via regulations.gov, docket ID nu
Reporting Timeline
If finalized, the data submission period would begin 60 days after the effective date of the final rule and last for three months.
Affected Entities
This action may apply to manufacturers (including importers) of PFAS for commercial purposes between January 1, 2011, and December 31, 2022, particularly in sectors including:
- Utilities (NAICS 22)
- Manufacturing (NAICS 31-33)
- Wholesale trade (NAICS 42)
- Waste management and remediation services (NAICS 562)
